Website Terms of Use

1. Purpose

These Terms of Use set out the conditions for accessing and using the website www.datakeen.co (the “Site”) by any person who visits it (the “User”). They do not govern customers’ use of the Datakeen platform, which is subject to the General Terms and Conditions of Sale and to the contract entered into with each customer.

2. Site publisher

The Site is published by Datakeen, a French simplified joint-stock company (SAS) with a share capital of €2,000, registered with the Nanterre Trade and Companies Register under number 825 303 910, with its registered office at 176 avenue Charles de Gaulle, 92200 Neuilly-sur-Seine, France. 3. Acceptance and amendment of these Terms

Use of the Site implies full acceptance of these Terms of Use. Datakeen may amend them at any time. The applicable version is the one online when the Site is accessed.

4. Access to the Site

The Site is available free of charge to any User with Internet access. Access and connection costs are borne by the User. Datakeen strives to keep the Site continuously available but does not guarantee it will be uninterrupted. It may suspend all or part of the Site, in particular for maintenance, without notice or compensation.

5. Services available on the Site

The Site allows Users in particular to:

• view information about Datakeen and its solutions;
• request a demo or contact Datakeen;
• download content (white papers, documentation);
• apply for job openings;
• read the blog.

The “Log in” button leads to the Datakeen platform, access to which is reserved for customers and governed by their contract.

6. Intellectual property

All elements of the Site are the exclusive property of Datakeen or its partners and are protected by intellectual property law. This includes in particular texts, articles, white papers, images, logos, trademarks, videos, software and the structure of the Site. Any reproduction, representation, adaptation or exploitation, in whole or in part, without Datakeen’s prior written consent is prohibited and constitutes infringement. Only personal, non-commercial use is permitted.

7. User obligations

The User agrees to use the Site fairly and lawfully. In particular, the User agrees not to interfere with its operation (intrusion, automated content extraction, distribution of malicious code, etc.) and to provide accurate information in forms.

8. Liability

Information published on the Site is provided for information purposes only and may change. It constitutes neither a contractual offer nor legal or regulatory advice. Datakeen shall not be liable for any damage resulting from the use of the Site, its unavailability, or the use of the information it contains.

9. Hyperlinks

The Site may contain links to third-party websites. Datakeen has no control over these websites and accepts no responsibility for their content. Links to the Site are permitted, except to pages or in a context that would harm Datakeen’s image.

10. Personal data and cookies

Data collected through the Site, in particular via forms, is processed in accordance with the GDPR and the French Data Protection Act. Details of this processing, the cookies used and Users’ rights are set out in the Privacy Policy.

11. Governing law and disputes

These Terms of Use are governed by French law. Failing an amicable settlement, any dispute shall be brought before the competent French courts, subject to mandatory rules applicable to consumers. This English version is provided for convenience; in case of discrepancy, the French version prevails.
